Equal Treatment in Public Procurement. Some „More Equal” than Others?

Résumé

In this study we aim to present equality of treatment in general compared to this principle in public procurement law, and to analyze its observance in the light of the interpretation of the regulations in this matter, in particular by the CJEU Decision of October 22, 2024 (Kolin' Case). The research highlights the relevant legislation, judicial practice and doctrinal sources, with the result of broadening the research on the topic in order to better understand and apply the legal provisions of the principle of equal treatment in public procurement law. Also, the study aims to identify possible shortcomings in the compliance of the principle of equal treatment in public procurement. Finally, the study outlines the conclusions drawn from the analysis of the topic.
