Theory and Practices regarding the Establishment of the Right of Usufruct
Abstract
The scientific research aims to identify, in the context of the Romanian civil legislation regarding the right of private property, the legal possibilities of establishing and/or acquiring the right of usufruct, regulated by the Civil Code as a main real right, dismemberment of private property. Therefore, we will examine in detail the general modalities established by the Civil Code in force, and in a future study we will complete the panoply of these modes of establishment, as indicated by the text of the law. Its fundamental purpose is to reveal and explore the legal regime of usufruct, illustrating its similarities, differences and practical implications.
