Legislative Changes Regarding Advertising Organized By The Trade Register

Abstract

Law no. 265/2022 on the trade register and for the amendment and completion of other normative acts affecting registration in the trade register, which entered into force on 26.11.2022 and was amended twice by Law no. 222 of 14 July 2023 and Emergency Ordinance no. 109 of 11 September 2024, significantly modified the publicity procedure organized by the trade register, both with regard to companies and individuals carrying out commercial activities in the form of an economic enterprise. These changes, some necessary, others to update the procedures in order to provide flexibility and simple access to starting economic activities, whether associated or individual, have had a significant impact on contemporary legal reality. A new element is the regulation of the profession of registrar by the trade register, after this need arose as a result of Government Emergency Ordinance no. 116/2009 for the establishment of measures regarding the activity of registration in the trade register, published in the Official Gazette of Romania, Part I, no. 926 of December 30, 2009, approved with amendments and completions by Law no. 84/2010, with subsequent amendments.
